Beta Program — Terms and Conditions

Please read these Terms and Conditions (“Terms”) carefully before accessing or using TVT Crew (“the App”), a workforce scheduling and team communication platform operated by Temecula Valley Tech (“we,” “us,” or “our”). By registering for or using the TVT Crew Beta Program, you agree to be bound by these Terms.
TVT Crew is currently offered as a free beta product. You acknowledge and agree that:

TVT Crew is intended for legitimate business workforce management purposes, including employee scheduling, availability tracking, and internal team communications. You agree not to use the App to:

We use this information solely to provide, maintain, and improve the TVT Crew platform. We do not sell personal data to third parties.
4.3 HIPAA Notice
TVT Crew is a workforce scheduling and communications tool and is NOT intended to store, transmit, or process Protected Health Information (PHI) as defined under the Health Insurance Portability and Accountability Act (HIPAA). You agree not to enter, upload, or share any PHI or other sensitive health information through the App. If your business is subject to HIPAA obligations, you are solely responsible for ensuring compliance. Temecula Valley Tech does not act as a Business Associate under HIPAA for purposes of this platform.
4.4 Data Security
We implement reasonable administrative, technical, and physical safeguards to protect your data. However, no system is completely secure, and we cannot guarantee the absolute security of data transmitted through the App during the beta period.
4.5 Data Retention
We may retain your data for the duration of the beta program and for a reasonable period thereafter. You may request deletion of your data by contacting us at the address below.
TVT Crew includes a team messaging feature. You are solely responsible for all content you post, send, or share through the chat. By submitting content, you represent that you have the right to do so and that the content does not violate any law or third-party rights.
We reserve the right (but have no obligation) to monitor, remove, or disable access to any content that violates these Terms or that we deem harmful to users or our platform.
TVT Crew is a tool designed to assist with employee scheduling and availability management. However:
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TEMECULA VALLEY TECH AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM (WHICH, DURING THE FREE BETA, SHALL BE $0).
If you provide feedback, suggestions, or ideas about the App, you grant Temecula Valley Tech a non-exclusive, royalty-free, perpetual license to use and incorporate such feedback into our products without any obligation to you.
Either party may terminate access to the App at any time. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including Sections 6, 7, 8, and 9) shall survive.
We may update these Terms from time to time. We will notify beta users of material changes via email or in-app notice. Continued use of the App after changes become effective constitutes your acceptance of the revised Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict of laws provisions. Any disputes arising under these Terms shall be resolved in the courts located in Riverside County, California.
